Domestic Workers Can Now Claim Compensation If Injured At Work

A recent ruling by the Constitutional Court has expanded on the rights of domestic workers in South Africa, which could be life-changing for the employees and their dependants. The Court confirmed that domestic workers who suffer injury, become disabled or contract a disease while on duty at the private home or premises of their employer may apply for compensation.

What does this mean for Employers & Employees?

In essence, any individual who works in a household as an employee as per the above mentioned decision has to be registered both with the Unemployment Insurance Fund and the Compensation Fund. Because this is required by law, there will be legal consequences for failing to register with the compensation fund. There will be penalties for failing to pay the annual assessment too. Failure to register or pay, could result in paying a fine or being prosecuted.

2021 will see Domestic Angels opening an office in Cape Town. We are very excited to announce that as of mid July we will commence training of Domestic workers and Childminders who are looking to find employment. Candidates will be sent for interviews with families that are seeking to employ either a Domestic worker or Childminder.
